Description:
Universal Credit staff are treating dormant or non-trading company directors as actively self-employed, even when there is no business activity or income. This results in unnecessary interviews, administrative burdens, and incorrect claimant conditionality.
Desired Outcome:
Correct classification based on actual trading activity, not directorship status. UC staff verify trading status rather than assuming it.
What Could Go Wrong:
Claimants misclassified as self-employed may be forced into inappropriate conditionality, face sanctions for not producing non-existent business evidence, or experience delays and distress.
Current Situation:
Director of two companies (one never traded, one inactive for 5 years) incorrectly flagged as 'self-employed'. Work Coach issued a self-employment appointment and requested irrelevant evidence.
Action Strategy:
Submit correction through journal, present declaration of non-trading, request update to 'not currently self-employed', escalate if necessary, document incident for PHC.
