Concern #594 - The ‘Just Give the House to the Kids’ Trap

Project:
500

Description:
Many UK homeowners nearing or in retirement consider transferring their home to their children to avoid care fees and inheritance tax. However, this can lead to unintended consequences, such as the 'gift with reservation of benefit' issue, where the home remains part of the estate for tax purposes. Additionally, councils may apply deprivation-of-assets rules, treating the home as still owned by the parent for care-fee assessments.

Desired Outcome:
Older homeowners and their families should seek qualified advice before transferring property. They should verify if there is an inheritance tax issue, ensure valid wills and powers of attorney are in place, understand gifting allowances, and consider trusts or property transfers only when suitable.

What Could Go Wrong:
Homeowners may lose control over their property, face family conflicts, incur unexpected tax or care-fee liabilities, and weaken their financial security, potentially becoming dependent on children whose circumstances may change.

Current Situation:
As inheritance tax thresholds remain frozen and pension funds are expected to be included in estates from April 2027, more estates face tax planning pressures. Many homeowners are considering property transfers without fully understanding the implications.

Action Strategy:
Encourage homeowners to pause and seek professional advice before making property transfers. They should assess their tax situation, establish proper legal documents, and explore alternative strategies like surplus income gifts or trusts.

I find this Open Concerns portal to be a tremendous resource for people around my age and for those with parents in a similar situation. I highly recommend it for the wealth of information it provides on topics related to wealth at pension age. I also believe it aligns well with the Open DWP project, and I plan to ask Oliver for assistance with that.
